In January of 1999, 30 year old Belinda Temple, who was eight months pregnant, was found shot to death in her closet in Katy, Texas. Her husband, David Temple, was tried and convicted twice for the murder of his pregnant wife. But when the jury at his second trial in 2019 became deadlocked in the punishment phase, a mistrial was declared. David appealed, and the long wait for resentencing began. This is an update on Episodes 127 & 128: The Belinda Temple Case.

1
00:00:04.400 --> 00:00:08.679
Southern Fried true crime covers cases that
are not suitable for young listeners, and
2
00:00:08.720 --> 00:00:16.359
there may also be some explicit language
used. Listener discretion is advised. Two
3
00:00:16.440 --> 00:00:21.079
years ago, I released episodes one
twenty seven and one twenty eight, a
4
00:00:21.120 --> 00:00:25.760
two part series on the Belinda Temple
case. As with many of my multi
5
00:00:25.760 --> 00:00:29.920
parter episodes, I had not originally
planned for it to be more than one
6
00:00:29.920 --> 00:00:34.240
episode, but the case has so
many twists and turns that there was no
7
00:00:34.320 --> 00:00:38.799
way to do it justice in one
episode. Since then, there have been
8
00:00:38.840 --> 00:00:43.880
some more twists. One in particular
is that a main witness for the prosecution,
9
00:00:44.200 --> 00:00:48.359
Belinda's best friend, Tammy Harlan,
was involved in a hit and run
10
00:00:48.439 --> 00:00:53.799
that cost a young man on a
bicycle his life. An anonymous tipster called
11
00:00:53.840 --> 00:00:58.320
in naming Tammy as the one who
killed the nineteen year old victim, David
12
00:00:58.359 --> 00:01:03.479
Grotberg, and said she was under
the influence at the time. When Tammy
13
00:01:03.560 --> 00:01:07.359
was brought in for questioning, she
admitted to drinking some wine that night and
14
00:01:07.400 --> 00:01:11.560
said she thought she had had a
stop sign. After a full investigation,
15
00:01:11.959 --> 00:01:15.319
Tammy was indicted in June twenty twenty
for failing to stop and render aid,
16
00:01:15.719 --> 00:01:23.519
but more importantly for manslaughter. As
with David Temple's resentencing hearing, Tammy's trial
17
00:01:23.640 --> 00:01:27.159
was on hold for the pandemic.
Her latest continuance was granted in April two
18
00:01:27.200 --> 00:01:30.799
thousand and three, but hopefully she
will stand trial soon for the death of
19
00:01:30.879 --> 00:01:37.480
David Grotberg. David Temple's hearing was
also held in April of two thousand and
20
00:01:37.519 --> 00:01:46.040
three, but luckily Timmy's alleged crimes
had no bearing on the testimony. Welcome
21
00:01:46.120 --> 00:01:53.680
to episode one ninety one update on
David Temple. If you haven't already,
22
00:01:53.879 --> 00:01:59.239
I do recommend you listen to both
episodes that I just rereleased, but for
23
00:01:59.319 --> 00:02:04.239
now, let me give you a
summary as a refresher. On January eleventh,
24
00:02:04.359 --> 00:02:07.319
nineteen ninety nine, thirty year old
Belinda Temple from Katie, Texas,
25
00:02:07.919 --> 00:02:12.439
was at home while her husband David
took their three year old son, Evan
26
00:02:12.479 --> 00:02:16.000
out to run errands. Belinda was
just three weeks away from giving birth to
27
00:02:16.080 --> 00:02:23.080
their second child and first daughter,
who they had planned on naming Aaron Ashley.
28
00:02:23.199 --> 00:02:27.719
Belinda was a caring and devoted mother
who was also passionate about her role
29
00:02:27.759 --> 00:02:32.599
as a special education teacher at Katie
High School. When thirty year old David
30
00:02:32.680 --> 00:02:37.960
arrived home with Evan around five thirty
that afternoon. He found the glass to
31
00:02:38.000 --> 00:02:42.599
their back door window was smashed in. Immediately, suspecting a robbery, but
32
00:02:42.759 --> 00:02:46.680
not knowing whether Belinda was okay,
David ran across the road to alert a
33
00:02:46.719 --> 00:02:51.680
neighbor. The men returned and entered
the property after David pitt the family dog,
34
00:02:51.840 --> 00:02:57.639
which was aggressive to strangers, and
the garage upstairs. Inside the closet
35
00:02:57.680 --> 00:03:01.080
of the main bedroom lay Belinda's body. She had been shot in the back
36
00:03:01.080 --> 00:03:06.800
of the head with a twelve gate
shotgun. Both she and her unborn baby
37
00:03:06.800 --> 00:03:13.240
girl died instantly. Police focused on
David as their suspect. However, there
38
00:03:13.280 --> 00:03:16.520
was no physical or forensic evidence linking
him to the murder. But if it
39
00:03:16.599 --> 00:03:21.319
was a robbery, as he had
suggested, why hadn't anything been stolen.
40
00:03:22.680 --> 00:03:25.639
The couple's jewelry and Belinda's purse,
which all would have been in plain view
41
00:03:25.680 --> 00:03:31.639
of the intruder, remained untouched.
Dresser drawers were pulled out but not ransacked,
42
00:03:31.960 --> 00:03:36.479
and a TV had just been laid
over on its side. Also,
43
00:03:36.919 --> 00:03:39.800
the murder weapon couldn't be located,
and David had no trace of blood or
44
00:03:39.800 --> 00:03:44.400
brain matter on him, as would
have been expected if he was the killer,
45
00:03:45.560 --> 00:03:50.719
but there was circumstantial evidence that told
a story. All had not been
46
00:03:50.759 --> 00:03:54.960
well in the couple's marriage. Belinda's
friends and family considered David a critical and
47
00:03:55.080 --> 00:04:01.800
unsupportive husband. Belinda's twin sister,
Brenda, found him to be particularly cruel
48
00:04:01.840 --> 00:04:05.960
to his pregnant wife, calling her
fat and not getting her gifts for her
49
00:04:06.000 --> 00:04:13.960
birthday or Christmas. Belinda's close friends
supported Brenda's story, and at the time
50
00:04:14.000 --> 00:04:17.079
of Belinda's death, David had also
been having an affair with his co worker,
51
00:04:17.279 --> 00:04:21.160
Heather Scott, who taught at Elif
Hastings High School, where David was
52
00:04:21.199 --> 00:04:27.920
a football coach, though obviously just
because someone is unfaithful doesn't mean they're a
53
00:04:27.959 --> 00:04:32.800
murderer. Over the next eighteen months, which would turn into years, Belinda's
54
00:04:32.800 --> 00:04:39.319
shattered family and friends wondered whether her
killer would ever be held accountable. Meanwhile,
55
00:04:39.920 --> 00:04:43.000
David was getting on with his life. In two thousand and one,
56
00:04:43.480 --> 00:04:47.480
he and Heather married. Finally,
in late two thousand four, David was
57
00:04:47.600 --> 00:04:53.319
arrested for Belinda's murder, and after
much legal wrangling, he was indicted the
58
00:04:53.360 --> 00:04:58.959
following year. In late two thousand
seven, David was convicted of murdering his
59
00:04:59.040 --> 00:05:03.839
pregnant wife. The prosecution successfully argued
his affair with Heather was the catalyst,
60
00:05:04.199 --> 00:05:10.240
and that David shot Belinda before staging
a burglary. Due to Texas laws in
61
00:05:10.240 --> 00:05:13.839
place at the time, David could
not be prosecuted for the murder of his
62
00:05:13.959 --> 00:05:19.120
unborn daughter. He was sentenced to
life in prison, but in twenty sixteen,
63
00:05:19.279 --> 00:05:25.240
after serving just nine years, David's
conviction was overturned, a retrial was
64
00:05:25.360 --> 00:05:29.920
ordered, and he was released on
bond. This was due to the prosecution's
65
00:05:29.920 --> 00:05:33.519
original failure to provide all evidence to
the defense in relation to a student and
66
00:05:33.600 --> 00:05:40.360
neighbor of Belinda's named Riley Joe Sanders. The defense wanted to present Sanders as
67
00:05:40.399 --> 00:05:44.680
an alternate suspect, especially since he
was said to have a grudge against Belinda.
68
00:05:45.800 --> 00:05:48.720
Under what is known as the Brady
Rule, prosecutors are required to disclose
69
00:05:48.759 --> 00:05:56.040
to the defense any potentially exculpatory material
relating to the accused. The materials said
70
00:05:56.040 --> 00:06:00.279
to have been withheld by Harris County
d A. Kelly Siegler related to aimes
71
00:06:00.319 --> 00:06:05.720
heavily implicating Sanders, which were much
later discredited. Sanders had been ruled out
72
00:06:05.720 --> 00:06:11.839
as a suspect by the team of
investigators on Belinda's case, and Siegler technically
73
00:06:11.839 --> 00:06:15.920
followed the Texas rule of law at
the time, but her behavior at her
74
00:06:15.959 --> 00:06:19.439
hearing was hostile and she was admonished
by the court and David was granted a
75
00:06:19.480 --> 00:06:25.560
new trial. However, he was
again found guilty at his second trial in
76
00:06:25.560 --> 00:06:30.160
two thousand nineteen. By then his
wife, Heather had divorced him. The
77
00:06:30.240 --> 00:06:36.439
prosecution again sought a life sentence,
but during the punishment phase, the jury
78
00:06:36.439 --> 00:06:41.879
became deadlocked. As a result,
the judge declared a mistrial and a new
79
00:06:41.920 --> 00:06:45.519
jury would need to decide David's fate. This was due to go ahead in
80
00:06:45.560 --> 00:06:49.399
March twenty twenty, but the pandemic
meant the new date for the sentencing kept
81
00:06:49.399 --> 00:06:56.319
being pushed back. David appealed the
mistrial ruling, requesting an entirely new trial
82
00:06:56.439 --> 00:07:00.079
with a new jury. In November
twenty twenty one, the Fourteenth Court of
83
00:07:00.079 --> 00:07:04.519
Appeals denied his submission, and David
remained in the Harris County jail on a
84
00:07:04.560 --> 00:07:12.079
one million dollar bond. According to
KPRC two News, his team was intent
85
00:07:12.199 --> 00:07:15.120
on appealing to the Court of Criminal
Appeals. This, of course meant further
86
00:07:15.199 --> 00:07:26.560
delays. I'm going to pause now
for a short commercial break. Finally,
87
00:07:26.839 --> 00:07:30.680
on April tenth, twenty twenty three, fifty four year old David's sentencing hearing
88
00:07:30.759 --> 00:07:36.519
began at the Harris County Courthouse.
By now a new prosecution team consisted of
89
00:07:36.600 --> 00:07:44.279
special prosecutors Lisa Tanner and Bill Turner
from the Texas Attorney General's Office. They
90
00:07:44.279 --> 00:07:48.279
were assigned following David's conviction being overturned
and the conflict of interest saw the Harris
91
00:07:48.360 --> 00:07:55.680
County Day's Office recuse itself from the
case. Lisa Tanner's opening question to the
92
00:07:55.720 --> 00:08:00.560
new jury about David Temple was pretty
simple, saying, he has been found
93
00:08:00.600 --> 00:08:03.279
guilty, so whether he did it
has been resolved. Now what are you
94
00:08:03.360 --> 00:08:07.959
going to do about it? The
prosecution made sure to lay out how David
95
00:08:09.040 --> 00:08:11.720
killed Belinda and staged a burglary,
pointing out that it would have been near
96
00:08:11.800 --> 00:08:16.240
impossible for an intruder to gain entry
with the family's aggressive dog on guard.
97
00:08:18.000 --> 00:08:24.399
Their argument as to motive was David's
relationship with Heather. The defense maintained that
98
00:08:24.439 --> 00:08:28.560
the issue of David's guilt wasn't the
slam dunk, the prosecution wanted the jury
99
00:08:28.560 --> 00:08:33.240
to think it was his attorney Stanley
Schneider told the jury the defense fully intended
100
00:08:33.279 --> 00:08:39.200
to explore some of the police investigation. Many of the same witnesses who had
101
00:08:39.240 --> 00:08:46.120
previously given evidence at David's past proceedings
were in attendance, and again they gave
102
00:08:46.159 --> 00:08:52.559
accounts consistent with their previous testimony.
According to The Houston Chronicle, David's ex
103
00:08:52.600 --> 00:08:56.759
wife, Heather nervously told the court
she had trouble remembering some of the key
104
00:08:56.840 --> 00:09:03.840
dates around their relationship before Belinda died. She did concur that when David was
105
00:09:03.879 --> 00:09:07.039
supposedly on a New Year's hunting trip
in nineteen ninety eight, he was actually
106
00:09:07.120 --> 00:09:13.039
staying with her. She also testified
that while she helped raise Evan, who
107
00:09:13.080 --> 00:09:16.039
called her mom, she and David
never once talked about Belinda's death in all
108
00:09:16.080 --> 00:09:22.480
their eighteen years of marriage, but
she did believe David was a loving and
109
00:09:22.559 --> 00:09:28.679
dedicated father who took Evan to visit
Belinda's grave. Nothing in Heather's testimony disparaged
110
00:09:28.720 --> 00:09:33.960
her ex husband. She agreed with
the prosecution that she told David they needed
111
00:09:33.000 --> 00:09:37.679
to end their affair, but then
in the days leading up to Belinda's murder,
112
00:09:37.080 --> 00:09:43.360
both Heather and David declared their love
for each other. David's sister in
113
00:09:43.440 --> 00:09:46.639
law, Rebecca Temple, testified for
the defense, telling the court that David
114
00:09:46.759 --> 00:09:50.440
was an amazing father who had worked
hard over the years to reconnect with his
115
00:09:50.559 --> 00:09:56.399
son. While Rebecca initially wanted nothing
to do with David following Belinda's death,
116
00:09:56.879 --> 00:10:01.759
according to the Houston Chronicle, she
now stated his marriage to Heather changed him
117
00:10:01.759 --> 00:10:05.840
for the better, testifying, I
saw a man that was softer and very
118
00:10:05.919 --> 00:10:11.000
caring and considerate. A key part
of the defense strategy appealing for leniency was
119
00:10:11.080 --> 00:10:16.960
David's apparent commitment to God, which
he had developed since first being incarcerated.
120
00:10:16.919 --> 00:10:22.879
Ex felons and even retired Texas Department
of Criminal Justice chaplain David Nichols spoke to
121
00:10:22.960 --> 00:10:28.440
David's devotion to his Christian faith as
well as his ministry during his time in
122
00:10:28.480 --> 00:10:33.200
prison. David's twenty eight year old
son, Evan, was consistent in his
123
00:10:33.320 --> 00:10:37.600
testimony. He spoke about having no
recollection of what happened on the day in
124
00:10:37.679 --> 00:10:43.200
question, let alone any memory of
his mother at all. The court heard
125
00:10:43.240 --> 00:10:48.840
how Evan felt abandoned as a child
by Belinda's family. This conflicted with her
126
00:10:48.879 --> 00:10:52.559
family's evidence, notably that they had
to obtain a court order to even see
127
00:10:52.600 --> 00:10:58.320
Evan. He testified how traumatized he
felt when his father was first sent to
128
00:10:58.399 --> 00:11:01.919
prison, saying, remember crying a
lot, hugging my mom Heather, and
129
00:11:03.000 --> 00:11:05.639
not knowing what was going to come
next or what life was going to look
130
00:11:05.679 --> 00:11:09.320
like without dad there. I want
my dad out of prison. I lost
131
00:11:09.399 --> 00:11:15.840
my dad once, I don't want
to lose him again. Evan maintained his
132
00:11:15.919 --> 00:11:18.519
father did not kill his mother,
though the court was directed to regard this
133
00:11:18.639 --> 00:11:24.080
not as fact but simply his opinion. In closing, David's lawyer asked the
134
00:11:24.159 --> 00:11:28.919
jury one question, focusing on Evan's
well being, asking what is the future
135
00:11:28.960 --> 00:11:33.600
of David Temple? As you think
about his future, you have to think
136
00:11:33.600 --> 00:11:39.559
about Evan. Punishing David is also
going to punish Evan. On April twenty
137
00:11:39.600 --> 00:11:43.480
first, twenty twenty three, after
two hours of deliberation, David Temple was
138
00:11:43.519 --> 00:11:48.360
once again sentenced to life in prison
plus a ten thousand dollars fine. He
139
00:11:48.440 --> 00:11:52.799
showed no emotion as the sentence was
read. It was a bittersweet moment for
140
00:11:52.840 --> 00:11:58.679
Belinda's family. Her mother Carol had
passed away in twenty fifteen, a year
141
00:11:58.720 --> 00:12:03.480
before David's conviction was overturned, so
she hadn't had to experience the turmoil of
142
00:12:03.519 --> 00:12:09.159
the second trial. Fighting back tears, Belinda's twin sister Brenda and brother Brian
143
00:12:09.519 --> 00:12:16.240
delivered emotional impact statements. Brenda's frustration
was palpable as you read. Belinda was
144
00:12:16.279 --> 00:12:20.639
my life. It has been hell
for me for the last twenty four years.
145
00:12:20.080 --> 00:12:24.480
I have suffered from PTSD. I
have felt survivor guilt. I will
146
00:12:24.519 --> 00:12:30.200
never understand why you killed Belinda.
David. You could have gotten divorced.
147
00:12:30.679 --> 00:12:33.440
You not only took Belinda away from
me, you took away my niece I
148
00:12:33.480 --> 00:12:39.159
never got to meet and watch grow
up. Brian told his brother in law,
149
00:12:39.559 --> 00:12:43.679
You're a despicable piece of trash.
You call our family white trash.
150
00:12:43.799 --> 00:12:46.720
Look at you, David. You
completely ruined our family. You ruined your
151
00:12:46.799 --> 00:12:52.240
family. No one else deprived Evan, no one else killed Belinda. That
152
00:12:52.320 --> 00:12:54.559
was your decision. I want you
to think about that for the rest of
153
00:12:54.559 --> 00:13:00.879
your life in prison and rot in
hell. The murder weapon used to kill
154
00:13:00.919 --> 00:13:05.159
Belinda Temple still has not been found. Almost twenty five years later, the
155
00:13:05.240 --> 00:13:11.159
time David had served while awaiting sentencing
was deducted from his total sentence. He
156
00:13:11.240 --> 00:13:13.919
will be eligible for parole in twenty
forty, when he will be seventy two
157
00:13:15.000 --> 00:13:18.679
years old, but the defense isn't
deterred and plans to appeal, which should
158
00:13:18.679 --> 00:13:26.679
surprise no one given how strongly David
maintains his innocence. Personally, I think
159
00:13:26.759 --> 00:13:31.120
David Temple is exactly where he belongs. If you listen to the original episodes
160
00:13:31.159 --> 00:13:35.279
on this case, I go into
great details supporting my belief, but I
161
00:13:35.440 --> 00:13:41.240
also play devil's advocate and illustrate the
holes in the case against David. I
162
00:13:41.279 --> 00:13:46.360
still believe he meticulously planned his wife's
murder, giving himself time to not only
163
00:13:46.440 --> 00:13:50.759
kill her, but also clean up
and get rid of the murder weapon,
164
00:13:50.120 --> 00:13:56.759
while still managing to give himself a
shaky alibi. And Riley Joe Sanders was
165
00:13:56.840 --> 00:14:01.200
thoroughly investigated and cleared, but also
since will tell you he and his friends
166
00:14:01.240 --> 00:14:07.360
did not have the wherewithal to execute
Belinda Temple without leaving any evidence behind.
167
00:14:07.960 --> 00:14:11.600
They were teenage potheads, not cold
blooded killers with a motive to kill Belinda.
168
00:14:13.120 --> 00:14:18.679
It was clear from the pristine crime
scene that Belinda's murder had been carefully
169
00:14:18.759 --> 00:14:22.759
planned. David was the only person
to have a real motive to kill his
170
00:14:22.840 --> 00:14:31.720
pregnant wife, and he almost got
away with it. Southern Fried True Crime

Y'all take care
1
00:00:04.400 --> 00:00:08.679
Southern Fried true crime covers cases that
are not suitable for young listeners, and
2
00:00:08.720 --> 00:00:16.359
there may also be some explicit language
used. Listener discretion is advised. Two
3
00:00:16.440 --> 00:00:21.079
years ago, I released episodes one
twenty seven and one twenty eight, a
4
00:00:21.120 --> 00:00:25.760
two part series on the Belinda Temple
case. As with many of my multi
5
00:00:25.760 --> 00:00:29.920
parter episodes, I had not originally
planned for it to be more than one
6
00:00:29.920 --> 00:00:34.240
episode, but the case has so
many twists and turns that there was no
7
00:00:34.320 --> 00:00:38.799
way to do it justice in one
episode. Since then, there have been
8
00:00:38.840 --> 00:00:43.880
some more twists. One in particular
is that a main witness for the prosecution,
9
00:00:44.200 --> 00:00:48.359
Belinda's best friend, Tammy Harlan,
was involved in a hit and run
10
00:00:48.439 --> 00:00:53.799
that cost a young man on a
bicycle his life. An anonymous tipster called
11
00:00:53.840 --> 00:00:58.320
in naming Tammy as the one who
killed the nineteen year old victim, David
12
00:00:58.359 --> 00:01:03.479
Grotberg, and said she was under
the influence at the time. When Tammy
13
00:01:03.560 --> 00:01:07.359
was brought in for questioning, she
admitted to drinking some wine that night and
14
00:01:07.400 --> 00:01:11.560
said she thought she had had a
stop sign. After a full investigation,
15
00:01:11.959 --> 00:01:15.319
Tammy was indicted in June twenty twenty
for failing to stop and render aid,
16
00:01:15.719 --> 00:01:23.519
but more importantly for manslaughter. As
with David Temple's resentencing hearing, Tammy's trial
17
00:01:23.640 --> 00:01:27.159
was on hold for the pandemic.
Her latest continuance was granted in April two
18
00:01:27.200 --> 00:01:30.799
thousand and three, but hopefully she
will stand trial soon for the death of
19
00:01:30.879 --> 00:01:37.480
David Grotberg. David Temple's hearing was
also held in April of two thousand and
20
00:01:37.519 --> 00:01:46.040
three, but luckily Timmy's alleged crimes
had no bearing on the testimony. Welcome
21
00:01:46.120 --> 00:01:53.680
to episode one ninety one update on
David Temple. If you haven't already,
22
00:01:53.879 --> 00:01:59.239
I do recommend you listen to both
episodes that I just rereleased, but for
23
00:01:59.319 --> 00:02:04.239
now, let me give you a
summary as a refresher. On January eleventh,
24
00:02:04.359 --> 00:02:07.319
nineteen ninety nine, thirty year old
Belinda Temple from Katie, Texas,
25
00:02:07.919 --> 00:02:12.439
was at home while her husband David
took their three year old son, Evan
26
00:02:12.479 --> 00:02:16.000
out to run errands. Belinda was
just three weeks away from giving birth to
27
00:02:16.080 --> 00:02:23.080
their second child and first daughter,
who they had planned on naming Aaron Ashley.
28
00:02:23.199 --> 00:02:27.719
Belinda was a caring and devoted mother
who was also passionate about her role
29
00:02:27.759 --> 00:02:32.599
as a special education teacher at Katie
High School. When thirty year old David
30
00:02:32.680 --> 00:02:37.960
arrived home with Evan around five thirty
that afternoon. He found the glass to
31
00:02:38.000 --> 00:02:42.599
their back door window was smashed in. Immediately, suspecting a robbery, but
32
00:02:42.759 --> 00:02:46.680
not knowing whether Belinda was okay,
David ran across the road to alert a
33
00:02:46.719 --> 00:02:51.680
neighbor. The men returned and entered
the property after David pitt the family dog,
34
00:02:51.840 --> 00:02:57.639
which was aggressive to strangers, and
the garage upstairs. Inside the closet
35
00:02:57.680 --> 00:03:01.080
of the main bedroom lay Belinda's body. She had been shot in the back
36
00:03:01.080 --> 00:03:06.800
of the head with a twelve gate
shotgun. Both she and her unborn baby
37
00:03:06.800 --> 00:03:13.240
girl died instantly. Police focused on
David as their suspect. However, there
38
00:03:13.280 --> 00:03:16.520
was no physical or forensic evidence linking
him to the murder. But if it
39
00:03:16.599 --> 00:03:21.319
was a robbery, as he had
suggested, why hadn't anything been stolen.
40
00:03:22.680 --> 00:03:25.639
The couple's jewelry and Belinda's purse,
which all would have been in plain view
41
00:03:25.680 --> 00:03:31.639
of the intruder, remained untouched.
Dresser drawers were pulled out but not ransacked,
42
00:03:31.960 --> 00:03:36.479
and a TV had just been laid
over on its side. Also,
43
00:03:36.919 --> 00:03:39.800
the murder weapon couldn't be located,
and David had no trace of blood or
44
00:03:39.800 --> 00:03:44.400
brain matter on him, as would
have been expected if he was the killer,
45
00:03:45.560 --> 00:03:50.719
but there was circumstantial evidence that told
a story. All had not been
46
00:03:50.759 --> 00:03:54.960
well in the couple's marriage. Belinda's
friends and family considered David a critical and
47
00:03:55.080 --> 00:04:01.800
unsupportive husband. Belinda's twin sister,
Brenda, found him to be particularly cruel
48
00:04:01.840 --> 00:04:05.960
to his pregnant wife, calling her
fat and not getting her gifts for her
49
00:04:06.000 --> 00:04:13.960
birthday or Christmas. Belinda's close friends
supported Brenda's story, and at the time
50
00:04:14.000 --> 00:04:17.079
of Belinda's death, David had also
been having an affair with his co worker,
51
00:04:17.279 --> 00:04:21.160
Heather Scott, who taught at Elif
Hastings High School, where David was
52
00:04:21.199 --> 00:04:27.920
a football coach, though obviously just
because someone is unfaithful doesn't mean they're a
53
00:04:27.959 --> 00:04:32.800
murderer. Over the next eighteen months, which would turn into years, Belinda's
54
00:04:32.800 --> 00:04:39.319
shattered family and friends wondered whether her
killer would ever be held accountable. Meanwhile,
55
00:04:39.920 --> 00:04:43.000
David was getting on with his life. In two thousand and one,
56
00:04:43.480 --> 00:04:47.480
he and Heather married. Finally,
in late two thousand four, David was
57
00:04:47.600 --> 00:04:53.319
arrested for Belinda's murder, and after
much legal wrangling, he was indicted the
58
00:04:53.360 --> 00:04:58.959
following year. In late two thousand
seven, David was convicted of murdering his
59
00:04:59.040 --> 00:05:03.839
pregnant wife. The prosecution successfully argued
his affair with Heather was the catalyst,
60
00:05:04.199 --> 00:05:10.240
and that David shot Belinda before staging
a burglary. Due to Texas laws in
61
00:05:10.240 --> 00:05:13.839
place at the time, David could
not be prosecuted for the murder of his
62
00:05:13.959 --> 00:05:19.120
unborn daughter. He was sentenced to
life in prison, but in twenty sixteen,
63
00:05:19.279 --> 00:05:25.240
after serving just nine years, David's
conviction was overturned, a retrial was
64
00:05:25.360 --> 00:05:29.920
ordered, and he was released on
bond. This was due to the prosecution's
65
00:05:29.920 --> 00:05:33.519
original failure to provide all evidence to
the defense in relation to a student and
66
00:05:33.600 --> 00:05:40.360
neighbor of Belinda's named Riley Joe Sanders. The defense wanted to present Sanders as
67
00:05:40.399 --> 00:05:44.680
an alternate suspect, especially since he
was said to have a grudge against Belinda.
68
00:05:45.800 --> 00:05:48.720
Under what is known as the Brady
Rule, prosecutors are required to disclose
69
00:05:48.759 --> 00:05:56.040
to the defense any potentially exculpatory material
relating to the accused. The materials said
70
00:05:56.040 --> 00:06:00.279
to have been withheld by Harris County
d A. Kelly Siegler related to aimes
71
00:06:00.319 --> 00:06:05.720
heavily implicating Sanders, which were much
later discredited. Sanders had been ruled out
72
00:06:05.720 --> 00:06:11.839
as a suspect by the team of
investigators on Belinda's case, and Siegler technically
73
00:06:11.839 --> 00:06:15.920
followed the Texas rule of law at
the time, but her behavior at her
74
00:06:15.959 --> 00:06:19.439
hearing was hostile and she was admonished
by the court and David was granted a
75
00:06:19.480 --> 00:06:25.560
new trial. However, he was
again found guilty at his second trial in
76
00:06:25.560 --> 00:06:30.160
two thousand nineteen. By then his
wife, Heather had divorced him. The
77
00:06:30.240 --> 00:06:36.439
prosecution again sought a life sentence,
but during the punishment phase, the jury
78
00:06:36.439 --> 00:06:41.879
became deadlocked. As a result,
the judge declared a mistrial and a new
79
00:06:41.920 --> 00:06:45.519
jury would need to decide David's fate. This was due to go ahead in
80
00:06:45.560 --> 00:06:49.399
March twenty twenty, but the pandemic
meant the new date for the sentencing kept
81
00:06:49.399 --> 00:06:56.319
being pushed back. David appealed the
mistrial ruling, requesting an entirely new trial
82
00:06:56.439 --> 00:07:00.079
with a new jury. In November
twenty twenty one, the Fourteenth Court of
83
00:07:00.079 --> 00:07:04.519
Appeals denied his submission, and David
remained in the Harris County jail on a
84
00:07:04.560 --> 00:07:12.079
one million dollar bond. According to
KPRC two News, his team was intent
85
00:07:12.199 --> 00:07:15.120
on appealing to the Court of Criminal
Appeals. This, of course meant further
86
00:07:15.199 --> 00:07:26.560
delays. I'm going to pause now
for a short commercial break. Finally,
87
00:07:26.839 --> 00:07:30.680
on April tenth, twenty twenty three, fifty four year old David's sentencing hearing
88
00:07:30.759 --> 00:07:36.519
began at the Harris County Courthouse.
By now a new prosecution team consisted of
89
00:07:36.600 --> 00:07:44.279
special prosecutors Lisa Tanner and Bill Turner
from the Texas Attorney General's Office. They
90
00:07:44.279 --> 00:07:48.279
were assigned following David's conviction being overturned
and the conflict of interest saw the Harris
91
00:07:48.360 --> 00:07:55.680
County Day's Office recuse itself from the
case. Lisa Tanner's opening question to the
92
00:07:55.720 --> 00:08:00.560
new jury about David Temple was pretty
simple, saying, he has been found
93
00:08:00.600 --> 00:08:03.279
guilty, so whether he did it
has been resolved. Now what are you
94
00:08:03.360 --> 00:08:07.959
going to do about it? The
prosecution made sure to lay out how David
95
00:08:09.040 --> 00:08:11.720
killed Belinda and staged a burglary,
pointing out that it would have been near
96
00:08:11.800 --> 00:08:16.240
impossible for an intruder to gain entry
with the family's aggressive dog on guard.
97
00:08:18.000 --> 00:08:24.399
Their argument as to motive was David's
relationship with Heather. The defense maintained that
98
00:08:24.439 --> 00:08:28.560
the issue of David's guilt wasn't the
slam dunk, the prosecution wanted the jury
99
00:08:28.560 --> 00:08:33.240
to think it was his attorney Stanley
Schneider told the jury the defense fully intended
100
00:08:33.279 --> 00:08:39.200
to explore some of the police investigation. Many of the same witnesses who had
101
00:08:39.240 --> 00:08:46.120
previously given evidence at David's past proceedings
were in attendance, and again they gave
102
00:08:46.159 --> 00:08:52.559
accounts consistent with their previous testimony.
According to The Houston Chronicle, David's ex
103
00:08:52.600 --> 00:08:56.759
wife, Heather nervously told the court
she had trouble remembering some of the key
104
00:08:56.840 --> 00:09:03.840
dates around their relationship before Belinda died. She did concur that when David was
105
00:09:03.879 --> 00:09:07.039
supposedly on a New Year's hunting trip
in nineteen ninety eight, he was actually
106
00:09:07.120 --> 00:09:13.039
staying with her. She also testified
that while she helped raise Evan, who
107
00:09:13.080 --> 00:09:16.039
called her mom, she and David
never once talked about Belinda's death in all
108
00:09:16.080 --> 00:09:22.480
their eighteen years of marriage, but
she did believe David was a loving and
109
00:09:22.559 --> 00:09:28.679
dedicated father who took Evan to visit
Belinda's grave. Nothing in Heather's testimony disparaged
110
00:09:28.720 --> 00:09:33.960
her ex husband. She agreed with
the prosecution that she told David they needed
111
00:09:33.000 --> 00:09:37.679
to end their affair, but then
in the days leading up to Belinda's murder,
112
00:09:37.080 --> 00:09:43.360
both Heather and David declared their love
for each other. David's sister in
113
00:09:43.440 --> 00:09:46.639
law, Rebecca Temple, testified for
the defense, telling the court that David
114
00:09:46.759 --> 00:09:50.440
was an amazing father who had worked
hard over the years to reconnect with his
115
00:09:50.559 --> 00:09:56.399
son. While Rebecca initially wanted nothing
to do with David following Belinda's death,
116
00:09:56.879 --> 00:10:01.759
according to the Houston Chronicle, she
now stated his marriage to Heather changed him
117
00:10:01.759 --> 00:10:05.840
for the better, testifying, I
saw a man that was softer and very
118
00:10:05.919 --> 00:10:11.000
caring and considerate. A key part
of the defense strategy appealing for leniency was
119
00:10:11.080 --> 00:10:16.960
David's apparent commitment to God, which
he had developed since first being incarcerated.
120
00:10:16.919 --> 00:10:22.879
Ex felons and even retired Texas Department
of Criminal Justice chaplain David Nichols spoke to
121
00:10:22.960 --> 00:10:28.440
David's devotion to his Christian faith as
well as his ministry during his time in
122
00:10:28.480 --> 00:10:33.200
prison. David's twenty eight year old
son, Evan, was consistent in his
123
00:10:33.320 --> 00:10:37.600
testimony. He spoke about having no
recollection of what happened on the day in
124
00:10:37.679 --> 00:10:43.200
question, let alone any memory of
his mother at all. The court heard
125
00:10:43.240 --> 00:10:48.840
how Evan felt abandoned as a child
by Belinda's family. This conflicted with her
126
00:10:48.879 --> 00:10:52.559
family's evidence, notably that they had
to obtain a court order to even see
127
00:10:52.600 --> 00:10:58.320
Evan. He testified how traumatized he
felt when his father was first sent to
128
00:10:58.399 --> 00:11:01.919
prison, saying, remember crying a
lot, hugging my mom Heather, and
129
00:11:03.000 --> 00:11:05.639
not knowing what was going to come
next or what life was going to look
130
00:11:05.679 --> 00:11:09.320
like without dad there. I want
my dad out of prison. I lost
131
00:11:09.399 --> 00:11:15.840
my dad once, I don't want
to lose him again. Evan maintained his
132
00:11:15.919 --> 00:11:18.519
father did not kill his mother,
though the court was directed to regard this
133
00:11:18.639 --> 00:11:24.080
not as fact but simply his opinion. In closing, David's lawyer asked the
134
00:11:24.159 --> 00:11:28.919
jury one question, focusing on Evan's
well being, asking what is the future
135
00:11:28.960 --> 00:11:33.600
of David Temple? As you think
about his future, you have to think
136
00:11:33.600 --> 00:11:39.559
about Evan. Punishing David is also
going to punish Evan. On April twenty
137
00:11:39.600 --> 00:11:43.480
first, twenty twenty three, after
two hours of deliberation, David Temple was
138
00:11:43.519 --> 00:11:48.360
once again sentenced to life in prison
plus a ten thousand dollars fine. He
139
00:11:48.440 --> 00:11:52.799
showed no emotion as the sentence was
read. It was a bittersweet moment for
140
00:11:52.840 --> 00:11:58.679
Belinda's family. Her mother Carol had
passed away in twenty fifteen, a year
141
00:11:58.720 --> 00:12:03.480
before David's conviction was overturned, so
she hadn't had to experience the turmoil of
142
00:12:03.519 --> 00:12:09.159
the second trial. Fighting back tears, Belinda's twin sister Brenda and brother Brian
143
00:12:09.519 --> 00:12:16.240
delivered emotional impact statements. Brenda's frustration
was palpable as you read. Belinda was
144
00:12:16.279 --> 00:12:20.639
my life. It has been hell
for me for the last twenty four years.
145
00:12:20.080 --> 00:12:24.480
I have suffered from PTSD. I
have felt survivor guilt. I will
146
00:12:24.519 --> 00:12:30.200
never understand why you killed Belinda.
David. You could have gotten divorced.
147
00:12:30.679 --> 00:12:33.440
You not only took Belinda away from
me, you took away my niece I
148
00:12:33.480 --> 00:12:39.159
never got to meet and watch grow
up. Brian told his brother in law,
149
00:12:39.559 --> 00:12:43.679
You're a despicable piece of trash.
You call our family white trash.
150
00:12:43.799 --> 00:12:46.720
Look at you, David. You
completely ruined our family. You ruined your
151
00:12:46.799 --> 00:12:52.240
family. No one else deprived Evan, no one else killed Belinda. That
152
00:12:52.320 --> 00:12:54.559
was your decision. I want you
to think about that for the rest of
153
00:12:54.559 --> 00:13:00.879
your life in prison and rot in
hell. The murder weapon used to kill
154
00:13:00.919 --> 00:13:05.159
Belinda Temple still has not been found. Almost twenty five years later, the
155
00:13:05.240 --> 00:13:11.159
time David had served while awaiting sentencing
was deducted from his total sentence. He
156
00:13:11.240 --> 00:13:13.919
will be eligible for parole in twenty
forty, when he will be seventy two
157
00:13:15.000 --> 00:13:18.679
years old, but the defense isn't
deterred and plans to appeal, which should
158
00:13:18.679 --> 00:13:26.679
surprise no one given how strongly David
maintains his innocence. Personally, I think
159
00:13:26.759 --> 00:13:31.120
David Temple is exactly where he belongs. If you listen to the original episodes
160
00:13:31.159 --> 00:13:35.279
on this case, I go into
great details supporting my belief, but I
161
00:13:35.440 --> 00:13:41.240
also play devil's advocate and illustrate the
holes in the case against David. I
162
00:13:41.279 --> 00:13:46.360
still believe he meticulously planned his wife's
murder, giving himself time to not only
163
00:13:46.440 --> 00:13:50.759
kill her, but also clean up
and get rid of the murder weapon,
164
00:13:50.120 --> 00:13:56.759
while still managing to give himself a
shaky alibi. And Riley Joe Sanders was
165
00:13:56.840 --> 00:14:01.200
thoroughly investigated and cleared, but also
since will tell you he and his friends
166
00:14:01.240 --> 00:14:07.360
did not have the wherewithal to execute
Belinda Temple without leaving any evidence behind.
167
00:14:07.960 --> 00:14:11.600
They were teenage potheads, not cold
blooded killers with a motive to kill Belinda.
168
00:14:13.120 --> 00:14:18.679
It was clear from the pristine crime
scene that Belinda's murder had been carefully
169
00:14:18.759 --> 00:14:22.759
planned. David was the only person
to have a real motive to kill his
170
00:14:22.840 --> 00:14:31.720
pregnant wife, and he almost got
away with it. Southern Fried True Crime
